ALL ABOUT ALBANIAN ECONOMIC ZONES


I. Introduction

‘Economic zones’ is a new concept that primarily aims at encouraging investments. An economic zone is a zone with a specific economic status and it can be a free zone or an industrial park. Operating a business within such zone implies exemption from some fiscal obligations. Any juridical person (Albanian or foreigner) with a business project can propose the creation of such a zone and the development of that zone by exercising the business within that zone, given that some conditions are met.

II. The legal basis for the creation of economic zones and for giving the status of developer for these zones:

1. Law number. 9789, dated 19.07.2007 “For the creation and functioning of the economic zones”
2. DCM nr.860, dated 10.10.2007 “For the approval of the Regulation for the creation and functioning of the economic zones”.
3. Law nr. 9663, dated 18.12.2006 “About the concessions” and DCM for its enforcement.

III. The Documentation

To proclaim the economic zone in the Council of Minister it is introduced the proposal of the Minister of Economy, Trade and Energy that should contain:

1.project decision
2.the map showing the surface that will be proclaimed economic zone
3.the opinion of the line Ministry or the organ of executive power, under jurisdiction of whom is the surface that will be proclaimed economic zone.
4.the documents from ZRPP that confirm the ownership status.

IV. Documents that should present the applicant for developer

They should be juridicial persons, Albanian or foreigner, certified with:

a) the document of foundation of the company
b) the certificate of the registration as a judicial person
c) the status of the company
d) NIPT (registration number for businesses)
e) a copy of the license of their activity
f) the balance-sheet of the last three years, certified by the accountable expert
g) the economic - technical profile of the company
h) in case of land or private immobile ownership, the documents of ownership or the act agreement about the land, or the land of the economic zone;
i) the business plan of the company as an applicant for developer of the economic zone;
j) the full construction project for the internal infrastructure and its relation with the exterior infrastructure;
k) the sources of financing for the project
l) the certification that the company is not under liquidation procedures, and that its principal administrator is not convicted. These certifications should not have a release date 3 months before the request
ll) the judicial foreign persons that apply for a developer license, should present the equivalent documents with them of the first paragraph of this article, the point a, b, c, d depending on the national legislation where the foreign person is registered
m) All documents should be translated in Albanian, in the original version or reckoning to the original version.

The investor that proposes the creation of the economic zone and acquirement of the status of developer for this zone should present the documents in the protocol of the Ministry in the form of a request. The documents will be sent back to be refilled if incomplete.
